Terms and conditions
At Fact DNA, we are committed to providing transparent and comprehensive legal information regarding our genetic testing and related services. This section outlines our terms of service, privacy policy, and other important legal considerations to ensure you are fully informed.
FACT DNA TERMS & CONDITIONS
Effective Date: March 02, 2019
Last Updated: August 31, 2026
Welcome to FACT DNA.
These Terms & Conditions (“Terms”) govern your access to and use of the FACT DNA website, products, testing services, wellness services, memberships, telehealth-related services, educational content, customer accounts, and other services offered by FACT DNA (“FACT DNA,” “we,” “us,” or “our”).
By accessing our website, creating an account, purchasing a product or service, ordering a test, enrolling in a membership, or otherwise using FACT DNA services, you agree to these Terms.
Please read these Terms carefully before using our services.
If you do not agree with these Terms, you should not use the website or purchase FACT DNA services.
1. ABOUT FACT DNA
FACT DNA provides access to a variety of health, wellness, laboratory, genetic testing, screening, educational, and related services.
Depending on the service selected, FACT DNA may work with independent laboratories, healthcare professionals, technology providers, specimen collection providers, pharmacies, telehealth providers, and other third-party service providers.
The specific services available to you may vary based on:
- Your location
- Applicable federal and state laws
- Laboratory availability
- Test availability
- Healthcare-provider requirements
- Age
- Medical or testing eligibility requirements
- Regulatory requirements
- Third-party service availability
Not every product or service is available in every state or jurisdiction.
2. ACCEPTANCE OF THESE TERMS
By using FACT DNA, you represent that:
- You are legally capable of entering into a binding agreement;
- The information you provide is accurate and complete;
- You will use the website and services only for lawful purposes;
- You will not use another person's account without authorization;
- You will comply with these Terms and applicable laws.
If you are purchasing a service for another individual, you represent that you have the legal authority to provide the information necessary to complete the purchase and obtain the applicable service.
3. CHANGES TO THESE TERMS
FACT DNA may modify these Terms from time to time.
Changes may be made to reflect:
- Changes in our services
- Changes in technology
- Changes in applicable law
- Changes in laboratory partners
- Changes in business practices
- Changes in pricing or membership programs
- Changes in regulatory requirements
When changes are made, we will update the Last Updated date.
Your continued use of the website or services after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
4. HEALTHCARE AND MEDICAL DISCLAIMER
FACT DNA provides different types of services, and not every FACT DNA product constitutes medical care.
Unless specifically stated otherwise for a particular service, information provided through the FACT DNA website, testing services, educational materials, reports, dashboards, emails, articles, blogs, or other communications is provided for informational, educational, screening, or wellness purposes.
FACT DNA services should not automatically be considered a substitute for:
- A physician
- A licensed healthcare professional
- A medical examination
- A diagnosis
- Individualized medical advice
- Emergency medical care
- Treatment prescribed by a qualified healthcare professional
You should discuss significant or concerning test results with an appropriately qualified healthcare professional.
Do not delay seeking medical care because of information obtained through FACT DNA.
If you believe you are experiencing a medical emergency, call 911 or seek emergency medical care immediately.
5. TEST RESULTS ARE NOT A DIAGNOSIS
Laboratory and genetic test results may provide useful information, but a test result alone may not establish a diagnosis or determine whether a person has or will develop a particular medical condition.
Test results may be affected by:
- Biological variation
- Timing of specimen collection
- Medications
- Supplements
- Diet
- Hydration
- Laboratory methodology
- Sample quality
- Collection procedures
- Testing limitations
- Genetic variation
- Changes in scientific knowledge
Some results may require additional testing, clinical evaluation, or confirmation by a healthcare professional.
FACT DNA does not guarantee that a test result will identify every medical condition, genetic variant, risk factor, or health issue.
6. GENETIC TESTING
Genetic testing can provide information about genetic variants, ancestry, traits, family relationships, health-related characteristics, or other genetic information depending on the test purchased.
Genetic testing has inherent limitations.
A genetic test may not identify:
- Every genetic variant
- Every disease-associated variant
- Every condition
- Every risk factor
- Every family relationship
- Every clinically relevant genetic change
Scientific understanding of genetics continues to evolve.
A result may therefore be reinterpreted in the future as scientific knowledge develops.
Where appropriate, FACT DNA recommends that customers discuss significant genetic findings with a qualified healthcare professional, genetic counselor, or other appropriately qualified professional.
The specific limitations, intended use, methodology, and applicable regulatory status of a genetic test may vary by test.
7. DIRECT-TO-CONSUMER TESTING
Certain FACT DNA tests may be ordered directly by consumers.
Not all direct-to-consumer tests have the same regulatory status, clinical purpose, methodology, or level of evidence.
The FDA notes that direct-to-consumer tests can vary in the evidence supporting their claims and that consumers should consider discussing results with a qualified healthcare provider or genetic counselor when appropriate.
FACT DNA does not represent that every test available through our website has been reviewed or authorized by the FDA.
Where a particular test has an applicable FDA authorization, clearance, approval, or other regulatory designation, the applicable test-specific information should be reviewed rather than assuming that designation applies to other FACT DNA tests.
8. LABORATORY SERVICES
FACT DNA may use independent laboratories or laboratory partners to perform testing.
The laboratory performing a test may have its own:
- Terms of service
- Privacy policy
- Test methodology
- Specimen requirements
- Result-reporting procedures
- Retention policies
- Regulatory requirements
The laboratory's applicable terms and disclosures may apply in addition to these Terms.
FACT DNA does not control the internal operations of independent laboratories.
9. SPECIMEN COLLECTION
Depending on the test, specimens may include:
- Blood
- Saliva
- Buccal cells
- Urine
- Other biological specimens
Collection instructions must be followed carefully.
A specimen may be rejected, delayed, or require recollection if it:
- Is improperly collected
- Is insufficient
- Is contaminated
- Is damaged
- Is mislabeled
- Does not meet laboratory requirements
- Cannot be processed for technical reasons
FACT DNA may require a replacement specimen before testing can be completed.
10. TEST RESULTS
Results may be delivered through:
- Secure online portals
- FACT DNA accounts
- Email notifications
- Laboratory portals
- Other secure electronic systems
- Other methods permitted by the applicable service
You are responsible for maintaining accurate contact information and protecting your account credentials.
FACT DNA is not responsible for unauthorized access caused by your failure to maintain the security of your account or login information.
11. RESULTS SHOULD BE REVIEWED IN CONTEXT
Reference ranges and laboratory results may vary between laboratories, methodologies, populations, and testing conditions.
A result outside a laboratory reference range does not necessarily mean that you have a disease or medical condition.
Likewise, a result within a reference range does not necessarily mean that you are free from disease or health risk.
Clinical interpretation should consider the individual's history, symptoms, medications, physical examination, other laboratory results, and other relevant factors.
12. WELLNESS INFORMATION
FACT DNA may provide wellness information concerning topics such as:
- Nutrition
- Vitamins
- Minerals
- Amino acids
- Exercise
- Sleep
- Lifestyle
- Weight management
- Metabolic health
- General wellness
Such information is intended to support education and wellness and should not be interpreted as a guarantee of a particular health outcome.
Where wellness recommendations are provided, you should consider your individual circumstances and consult an appropriately qualified healthcare professional when appropriate.
13. NO GUARANTEE OF HEALTH OUTCOMES
FACT DNA does not guarantee that use of any test, report, supplement, wellness recommendation, monitoring program, membership, or other service will:
- Prevent disease
- Cure disease
- Treat disease
- Reverse a medical condition
- Cause weight loss
- Increase energy
- Improve athletic performance
- Extend lifespan
- Prevent hospitalization
- Eliminate the need for medication
- Produce a particular health outcome
Individual results vary.
Any health-related claim made by FACT DNA should be understood in accordance with the specific product description, applicable disclosures, scientific evidence, and limitations associated with that service.
14. TELEHEALTH AND HEALTHCARE SERVICES
If FACT DNA offers or facilitates access to telehealth or healthcare services, those services may be provided by independent healthcare professionals or third-party healthcare organizations.
The healthcare professional—not FACT DNA—may be responsible for determining whether:
- You are appropriate for a particular treatment
- A prescription is medically appropriate
- Additional testing is necessary
- A diagnosis can be made
- A treatment plan should be changed
FACT DNA does not guarantee that a healthcare professional will prescribe a medication, approve a treatment, or provide a particular medical service.
Prescribing decisions remain within the professional judgment of the appropriately licensed healthcare professional.
Telehealth availability may vary by state.
15. MEDICATIONS AND PRESCRIPTIONS
Where a service involves prescription medication, prescriptions are subject to applicable law and the independent professional judgment of an appropriately licensed healthcare provider.
FACT DNA does not guarantee that a prescription will be issued.
You should not begin, stop, increase, decrease, or change a prescription medication based solely on information obtained from the FACT DNA website or a laboratory report.
Medication questions should be directed to your prescribing healthcare professional or pharmacist.
16. MEMBERSHIPS
FACT DNA may offer membership programs that provide access to specified testing, monitoring, wellness, telehealth, or other services.
Membership benefits vary by plan.
Membership enrollment may require:
- A recurring payment method
- Agreement to recurring billing
- Completion of required forms
- Eligibility for the applicable service
- Compliance with applicable testing schedules
Membership benefits are limited to the services specifically included in the membership selected.
17. MEMBERSHIP RENEWALS
Unless otherwise stated during checkout, membership plans may automatically renew according to the billing cadence selected by the customer.
The applicable renewal cadence may include monthly, quarterly, or other available intervals.
Before purchasing a membership, customers should review:
- Membership price
- Renewal frequency
- Included services
- Cancellation terms
- Applicable fees
- Testing schedule
- Any applicable limitations
You may cancel your membership according to the cancellation procedures provided by FACT DNA.
Cancellation generally prevents future renewals but does not necessarily result in a refund for services already provided or periods already billed, except where required by law or expressly stated in the applicable membership terms.
18. MEMBERSHIP TESTING SCHEDULES
If a membership includes recurring testing, the testing schedule selected by the customer may affect when testing is available.
Testing schedules do not necessarily mean that a customer will receive a medical test at every billing date.
Specific testing availability depends on the membership selected and the applicable laboratory and service requirements.
19. PRICING
Prices displayed on FACTDNA.com are subject to change.
We may correct pricing errors, typographical errors, or other inaccuracies.
If a significant pricing error occurs, FACT DNA may cancel an affected order and provide a refund of amounts actually paid for that order.
Prices may vary based on:
- Test type
- Membership plan
- Location
- Laboratory
- Promotional pricing
- Insurance or payment arrangements
- Third-party services
20. PAYMENT
FACT DNA may accept various payment methods, which may include:
- Credit cards
- Debit cards
- HSA/FSA cards where eligible
- Financing or pay-over-time options
- Other payment methods displayed during checkout
Payment processors may have their own terms and privacy practices.
You authorize FACT DNA and/or its payment processor to charge the payment method you provide for authorized purchases and recurring services.
21. HSA AND FSA PAYMENTS
FACT DNA may accept HSA or FSA payment methods for certain services.
However, eligibility for reimbursement is determined by applicable law, your plan administrator, and the terms governing your HSA or FSA account.
FACT DNA does not guarantee that a particular product or service will qualify for reimbursement.
Customers are responsible for confirming eligibility with their HSA/FSA administrator.
22. REFUNDS AND CANCELLATIONS
Refund eligibility depends on the product or service purchased.
Because certain laboratory services involve costs incurred when an order is placed, some testing services may become non-refundable once:
- A laboratory order has been submitted;
- A specimen collection kit has been activated;
- A specimen has been collected;
- Testing has begun;
- A healthcare professional consultation has occurred; or
- A third-party service has been provided.
Any product-specific refund or cancellation policy displayed at checkout will apply to that purchase.
Where required by applicable law, statutory cancellation or refund rights will not be limited by this section.
23. TESTING DELAYS
Testing may occasionally be delayed because of:
- Laboratory processing times
- Shipping delays
- Specimen problems
- Insufficient specimens
- Recollection requirements
- Equipment problems
- Quality-control procedures
- Holidays
- Weather
- Third-party service interruptions
- Regulatory requirements
- Other circumstances outside FACT DNA's reasonable control
Estimated turnaround times are estimates and are not guarantees unless expressly stated otherwise.
24. TEST RECOLLECTION
If a specimen cannot be processed or produces an invalid or inconclusive result, a recollection may be required.
Depending on the circumstances and applicable policy, FACT DNA may provide a replacement collection kit or other instructions.
A recollection does not necessarily mean that the original result was abnormal.
25. ACCOUNT RESPONSIBILITIES
If you create a FACT DNA account, you agree to:
- Provide accurate information
- Keep your login credentials confidential
- Notify us of unauthorized account activity
- Update your contact information
- Use your account only for lawful purposes
You are responsible for activity occurring through your account unless caused by FACT DNA's failure to use reasonable security measures.

Message and data rates may apply to text messaging depending on your mobile carrier.
You may opt out of promotional communications where applicable.
Service-related communications may continue when necessary to complete or administer your transaction or service.

32. LABORATORY AND PARTNER DISCLAIMERS
Where FACT DNA partners with an independent laboratory or other service provider, the third party may be responsible for performing certain portions of the service.
FACT DNA does not guarantee that a third-party provider will remain available indefinitely.

35. LIMITATION OF WARRANTIES
To the maximum extent permitted by applicable law, FACT DNA provides its website and general services on an “AS IS” and “AS AVAILABLE” basis.
To the extent permitted by law, FACT DNA does not guarantee that:
- The website will always be available;

- Results will always be available within an estimated timeframe;

Nothing in these Terms is intended to eliminate any warranty or consumer right that cannot legally be excluded.
36. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, FACT DNA and its officers, directors, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the website or services.
To the extent permitted by applicable law, FACT DNA's total liability arising from a particular purchase or service will not exceed the amount actually paid by you to FACT DNA for the specific product or service giving rise to the claim.
This limitation does not apply where prohibited by law or to liability that cannot legally be limited or excluded.
37. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless FACT DNA and its officers, directors, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from:

Certain FACT DNA services may also be subject to the laws of the state in which the customer receives the service.
40. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permissible.

Scientific knowledge changes over time, and different laboratories and testing methodologies may produce different results.
When appropriate, customers should discuss significant results with a qualified healthcare professional.
